Welcome to Beat’s Web Design! These Terms and Conditions outline the policies, responsibilities, and expectations associated with our website design, development, hosting, maintenance, and related services.
By purchasing services from Beat’s Web Design and accepting these Terms through an applicable agreement, proposal, or checkout process, you agree to the terms that govern your services.
Use of our public website is also subject to the website-use provisions below.
1. Services
Beat’s Web Design provides professional website design, website development, website hosting, maintenance, website updates, basic search engine optimization (SEO), and related digital services.
We offer website design packages and standalone website hosting plans.
The specific services, deliverables, features, pricing, and limitations of each package are described on our Pricing page or in an individual written proposal.

If an individual written agreement or accepted proposal differs from the general package terms, that agreement will govern the specifically agreed services.
2. Website Design Packages
Our standard website design packages include the following:
One-Page Website Package
$199 one-time website development fee
$19.95 per month for hosting and maintenance
First month’s hosting free
One-page website with up to five focused content sections
Standard domain name included
Website hosting
Monthly security updates and backups
Basic SEO setup
One custom domain email account
Up to one hour of website changes per month
2–5 Page Website Package
$299 one-time website development fee
$29.95 per month for hosting and maintenance
First month’s hosting free
Two to five website pages, within the published content guidelines
Standard domain name included
Website hosting
Monthly security updates and backups
Basic SEO setup
Up to three custom domain email accounts
Up to two hours of website changes per month
6–10 Page Website Package
$499 one-time website development fee
$49.95 per month for hosting and maintenance
First month’s hosting free
Six to ten website pages, within the published content guidelines
Standard domain name included
Website hosting
Monthly security updates and backups
Basic SEO setup
Up to five custom domain email accounts
Up to three hours of website changes per month
These prices and features apply to standard projects. Additional development, custom functionality, integrations, content-heavy pages, or services beyond the selected package may require a separate quote.
The features and pricing stated in the client’s accepted agreement will apply to that purchase unless changed by mutual agreement or as otherwise permitted by law.
3. Website Content and Project Scope
Our website packages are intended to provide affordable, professional websites with organized, easy-to-navigate content.
The number of pages, sections, and amount of content included in each package are limited to the published content guidelines and the agreed project scope.
Additional services may require a separate quote, including:
Additional pages or sections
Extensive content writing or rewriting
Advanced SEO campaigns
Ecommerce or online booking systems
Custom forms or advanced file-upload functionality
Specialized integrations or custom programming
Large galleries, extensive data entry, or content migration
Major redesigns or functionality changes
We will discuss and obtain approval for additional charges before completing work outside the agreed scope.
4. Quotes and Project Agreements
Quotes and proposals are based on the information provided by the client at the time of the estimate.
Before beginning development, Beat’s Web Design may provide a description of the project scope, selected package, additional features, pricing, and payment requirements.
Any substantial changes to the original requirements may affect the project cost or completion timeline.
We will communicate proposed additional fees before performing extra billable work.
5. Payments and Setup Fees
Website development setup fees are due before development begins unless otherwise agreed in writing.
These fees cover the time and resources necessary to plan, design, configure, and develop the website.
The setup fee pays for development services and does not depend solely on whether the client ultimately chooses to publish or launch the completed website.
Additional services, third-party purchases, or features outside the standard package may require separate payment.
Beat’s Web Design may pause work when required payments are overdue.
6. Setup Fee Refunds and Project Cancellations
We understand that circumstances may change during a website project. Our refund policy is intended to be fair to both the client and Beat’s Web Design.
Before Development Begins
If a client cancels before any project work has started and no nonrecoverable expenses have been incurred, the one-time setup fee will be fully refunded.
After Development Has Started
If a client cancels after development has begun, a partial refund may be available based on the amount of work completed and any approved, nonrecoverable project expenses.
We will provide a reasonable explanation of any amount retained.
After Website Completion
Once the website has been substantially completed according to the agreed scope and made available for client review, the setup fee is considered earned and is generally non-refundable, even if the client decides not to launch or publish the website.
If We Cannot Complete the Project
If Beat’s Web Design is unable to provide the agreed services, we will work with the client to determine an appropriate resolution, which may include a refund for services not delivered.
All refund provisions are subject to applicable law and any additional rights provided by the client’s written agreement.
7. Client Responsibilities
Clients are responsible for providing the materials and information reasonably necessary to complete their website, including:
Accurate business and contact information
Business logos, branding materials, and images
Information about products or services
Requested website content and project details
Access to applicable third-party accounts
Timely feedback and approvals
Payment according to agreed terms
Clients must have the appropriate rights or permissions to use any content, trademarks, photos, logos, or other materials they provide.
We are not responsible for delays resulting from missing materials, inaccurate information, or delayed client responses.
8. Inactive or Abandoned Website Projects
To keep projects moving forward, clients are expected to respond to reasonable requests for required information, feedback, or approval.
If a client does not respond for 30 consecutive days, Beat’s Web Design may place the project on hold.
If the client remains unresponsive for 60 consecutive days, we may issue written notice that the project is subject to closure.
If no response is received within 14 days after that notice, we may close the project.
Project closure does not automatically qualify the client for a refund. Any refund will be determined according to the amount of work completed, documented project expenses, the agreed contract, and applicable law.
If a closed project is later reopened, a new timeline or additional development fees may apply. Any additional fees will be disclosed and approved in advance.
9. Website Reviews and Revisions
Clients will have an opportunity to review their website before launch and identify changes needed to meet the agreed project requirements.
Included prelaunch revisions are based on the selected package or written project agreement.
Corrections needed to bring the website into conformity with the agreed scope will be addressed without additional development charges.
Significant redesign requests, changes in project direction, additional content, new features, or work beyond the original agreement may require additional fees.
10. Website Launch and Approval
Once the website is ready for review, we will notify the client and request any necessary feedback or approval.
After the agreed requirements have been met and required launch information has been received, the website may be published.
If the client chooses not to launch the completed website, the applicable setup fee refund terms will still apply.
The first free month of the bundled hosting and maintenance plan begins when the website is launched, unless a different commencement date is expressly agreed in writing.
If a client delays launch for an extended period, the project may be paused or closed under our inactive-project policy.
11. Monthly Hosting and Maintenance Plans
Our website design packages include recurring hosting and maintenance services at the rates specified in the selected package.
Services may include:
Website hosting
Routine website maintenance
Security-related updates
Scheduled backups
Basic technical support
Website content updates within the monthly allowance
Applicable domain and email services
Website hosting and maintenance are ongoing services separate from the original development work.
Monthly services continue on a month-to-month basis after any promotional free month unless canceled.
Standalone hosting packages include only the features listed for the specific hosting plan. Website maintenance, content changes, and other managed services are not included in hosting-only plans unless expressly stated.
12. Free First Month and Recurring Billing
Eligible website design packages include the first month of hosting and maintenance at no charge.
Unless otherwise agreed, the free month begins on the website launch date.
After the free month ends, the regular monthly rate for the selected package applies.
For example, the One-Page Website Package includes:
$199 one-time website development fee
First month of hosting and maintenance free
$19.95 monthly hosting and maintenance thereafter
Recurring charges will only be processed automatically when the client has expressly authorized automatic billing.
Clients will be informed of the recurring amount, billing frequency, and cancellation method before authorizing recurring payments.
Hosting-only plans and separately quoted services follow their own agreed billing terms and do not automatically include promotional offers.
13. Monthly Website Updates
Website design packages include a limited amount of website changes each month based on the selected plan:
One-Page Website: Up to 1 hour per month
2–5 Page Website: Up to 2 hours per month
6–10 Page Website: Up to 3 hours per month
Monthly update time may be used for routine content changes such as updating text, replacing images, adjusting contact information, and making minor layout changes.
Unused update time does not roll over or accumulate.
Updates do not include major redesigns, new pages, custom development, extensive content creation, or advanced SEO services unless separately agreed.
Requests exceeding the monthly allowance may require an additional quote.
14. Monthly Plan Cancellations
Clients may cancel their month-to-month hosting and maintenance plan at any time by contacting us at:
Clients who enrolled in automatic recurring billing online may use an available online cancellation method or an immediately accessible cancellation email process, as required by applicable law.
Cancellation stops future recurring charges according to the applicable billing arrangement. There is no separate cancellation penalty for standard month-to-month plans.
Monthly fees already paid are generally non-refundable for the service period that has begun, except where required by law or otherwise agreed.
Clients should request website files, domain transfers, or other necessary account information before hosting services end.
Following cancellation, Beat’s Web Design will coordinate the end of hosting services and any requested transfer assistance.
A website hosted through Beat’s Web Design may become unavailable when its hosting service ends unless it is transferred to another provider.
15. Overdue Payments and Service Suspension
Monthly invoices and other charges are due according to the agreed billing schedule.
If payment becomes overdue, we may contact the client and request payment before taking further action.
If an outstanding balance remains unpaid after reasonable notice, we may temporarily suspend website hosting, maintenance, or related services until the account is brought current.
Continued nonpayment may result in service termination.
Where reasonably possible, clients will be given an opportunity to resolve outstanding balances or request eligible website materials before permanent removal of hosted content.
We are not responsible for losses resulting from properly noticed service interruptions due to unpaid invoices, except as required by law.
16. Domain Names and Registration
Eligible website design packages include a standard domain name, subject to availability and any exclusions disclosed before purchase.
Included registration and standard renewal costs are covered while the applicable website plan remains active, unless otherwise agreed.
Premium domains, special domain extensions, transfer fees, or other unusual registration expenses may require additional charges with prior approval.
Clients are intended to be the registrants of domain names obtained specifically for their businesses, subject to applicable registrar policies and the agreed registration arrangements.
Upon cancellation, clients may request the transfer of an eligible domain name to another provider.
Domain transfers may be subject to registrar requirements, transfer restrictions, renewal obligations, or third-party fees.
If the hosting and maintenance plan is canceled, future domain registration or renewal costs become the client’s responsibility unless separately agreed.
17. Website Ownership and Transfers
After all required development payments have been made, the client owns the original website content and custom deliverables created specifically for the project, except for materials subject to separate licensing or ownership restrictions.
Beat’s Web Design retains ownership of any pre-existing templates, reusable code, proprietary processes, tools, or other materials not specifically transferred to the client.
Third-party plugins, themes, fonts, stock images, and software remain subject to their respective licenses.
Clients may request available copies of their website files and database, where applicable, for transfer to another compatible hosting provider.
We will reasonably assist with access to client-owned website materials and eligible domain transfer information.
Technical migration, restoration, reconfiguration, or compatibility work requested beyond the standard transfer of available materials may require a separate quote.
Clients are responsible for arranging replacement hosting, ongoing licensing, and maintenance if they discontinue services with Beat’s Web Design.
18. Backups and Data Retention After Cancellation
Eligible maintenance packages include scheduled website backups according to the applicable plan.
Although we take reasonable precautions, backups are not a guarantee against every possible instance of data loss.
Clients are encouraged to retain copies of important business information and website content.
After hosting services end, website files, databases, email accounts, and backups may be removed from our systems in accordance with applicable retention procedures and legal requirements.
Clients should request any necessary website exports or account information before the effective end of service.
19. Website Security and Third-Party Services
We take reasonable steps to maintain websites and hosting environments within the scope of the selected service plan.
However, no website or hosting provider can guarantee complete protection against:
Hacking or unauthorized access
Malware or malicious attacks
Software vulnerabilities
Third-party outages
Hosting interruptions
Plugin or theme conflicts
Data loss or unexpected technical failures
Some services depend on third-party providers, including domain registrars, software developers, payment processors, and hosting infrastructure.
We are not responsible for third-party failures outside our reasonable control, except as required by applicable law.
20. SEO and Business Results
Eligible website design packages include basic SEO setup.
This may include foundational search-friendly website structure, page titles, descriptions, and other basic optimization practices appropriate to the agreed project.
Basic SEO does not include ongoing SEO campaigns, guaranteed search rankings, link-building campaigns, extensive location pages, or advanced local SEO unless separately agreed.
We do not guarantee specific positions in Google or other search engines.
Likewise, we cannot guarantee a particular number of website visitors, leads, sales, or other business results.
Search engine performance depends on many factors outside our control, including competition, website content, business reviews, location, search engine policies, and algorithm changes.
21. Client Content, Privacy, and Legal Compliance
Clients are responsible for ensuring that the content and business practices associated with their website comply with applicable laws and regulations.
This includes obtaining appropriate permissions for images, logos, trademarks, customer testimonials, and other submitted materials.
Clients are also responsible for determining which privacy notices, cookie notices, customer consent mechanisms, disclaimers, and business disclosures their websites require.
When we build forms or other website features that collect customer information, we may provide technical implementation assistance, but the client remains responsible for establishing lawful collection and use of that information.
Legal compliance services are not included unless expressly agreed in writing.
22. Portfolio and Promotional Use
Unless a client requests otherwise, Beat’s Web Design may display publicly available screenshots, completed website designs, project descriptions, and business names in our portfolio or marketing materials.
We will not intentionally publish private project materials or confidential client information for promotional purposes without permission.
Clients may contact us to request that a project not be featured in future promotional materials.
23. Limitation of Liability
To the extent permitted by applicable law, Beat’s Web Design is not responsible for indirect, incidental, special, or consequential losses arising from the use of our services, including lost profits, business interruptions, search ranking changes, or failures involving third-party providers.
To the extent permitted by applicable law, our total liability for claims arising from a particular service will not exceed the fees paid for that service during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability or limits customer rights that cannot legally be excluded or limited.
24. Acceptable Website Use
Users and clients agree not to use our website or services to:
Engage in unlawful or fraudulent activities
Distribute malicious software or harmful content
Attempt unauthorized access to systems or accounts
Send unlawful spam or abuse hosting resources
Violate intellectual property rights
Interfere with website functionality or security
We may suspend or terminate services for serious violations, subject to applicable law and agreed contractual obligations.
25. Termination of Services
Beat’s Web Design may suspend or terminate services for material nonpayment, serious violations of these Terms, unlawful activity, abusive conduct, or other legitimate reasons permitted by law.
When appropriate, we will provide reasonable notice and an opportunity to resolve the issue before termination.
Cancellation or termination does not automatically eliminate outstanding payment obligations for services already provided.
Any applicable refunds, domain transfers, website ownership rights, and data-export requests will be handled according to these Terms and the client’s written agreement.
26. Changes to These Terms
We may update these Terms and Conditions to reflect changes in our business practices, services, or legal requirements.
Changes will be posted on this page with an updated effective date.
Changes will not retroactively alter an existing client’s agreed pricing or material contractual rights without appropriate notice, agreement, or another lawful basis.
27. Governing Law
These Terms are governed by the laws of the State of Kansas, to the extent permitted by applicable law and without overriding mandatory legal protections that apply to a client.
